The terms that govern your use of ChargeControl
These Terms of Service explain the license you receive, how reimbursement and energy services work, and each party's rights and obligations.
Overview
These terms apply to your use of ChargeControl services and platform.
Definitions
- “Platform” — The ChargeControl web application, APIs and related services.
- “User” — Any natural or legal person using the Platform.
- “Customer” — The organization that has an agreement with ChargeControl.
- “Driver” — An end user who registers charging sessions.
Services
- Automated home charging reimbursement with evidence packs, policy engine, and payroll integration
- Guided onboarding, marketplace orchestration, and installation coordination
Energy Services
Smart charging with EPEX Spot prices, solar optimization, battery arbitrage, V2G, and home energy management.
Usage Terms
Permitted Use
You may use the Platform in accordance with the agreed license and solely for legitimate business purposes related to electric vehicle management.
Prohibited Activities
- Fraudulent session registration or data manipulation
- Unauthorized access to accounts or systems
- Reverse engineering of the Platform
- Resale or sublicensing without permission
Reimbursement Processing
When using Chargeback services:
- Reimbursements are calculated based on registered kWh and approved tariffs
- Home charging is reimbursed at actual energy cost, not CPO roaming rates
- The employer is responsible for final approval and payment
- ChargeControl does not guarantee payment by employers
- Session data is blockchain-verified for integrity
- Evidence packs with session measurements, rate substantiation, and approval records are generated for every reimbursement
AI Services
The Platform uses AI agents for operational automation. These agents process data in accordance with GDPR and these terms:
- AI agents automate routine tasks such as session verification, anomaly detection, and support context
- No automated decision-making with legal consequences without human oversight
- AI models are trained on anonymized and aggregated data
- You may request information about AI processing of your data at any time
Energy Services and Market Participation
When using energy services such as smart charging, VPP participation, or ERE trading:
- Energy price data is processed from EPEX Spot and other market sources
- VPP participation requires explicit consent and can be terminated at any time
- Energy certificates (ERE) are traded under applicable energy market regulations
- Smart meter data via P1 dongle is processed only with your consent
Intellectual Property
All rights to the Platform, including software, design and documentation, remain the property of ChargeControl B.V. You obtain a non-exclusive, non-transferable license for use according to these terms.
Availability and Maintenance
- Target availability: 99.5% (excluding scheduled maintenance)
- Scheduled maintenance: outside business hours with 24-hour notice
- Emergency maintenance: as soon as possible with minimal disruption
Liability
ChargeControl is not liable for:
- Indirect, incidental or consequential damages
- Damage from incorrect data provided by users
- Damage from failures at third parties (charging networks, energy providers)
- Lost profits or revenue
Maximum liability is limited to the amount Customer has paid in the 12 months preceding the claim.
Termination
Either party may terminate the agreement with 30 days written notice. Upon termination:
- Access to the Platform is revoked
- Data export is available for 30 days after termination
- Outstanding reimbursements are finalized
Governing Law
These terms are governed by Dutch law. Disputes are submitted to the competent court in Rotterdam.
Changes
ChargeControl may modify these terms with 30 days notice. Continued use after modification means acceptance of the new terms.
